In South Carolina, the paperwork left behind by DHEC’s breakup is getting another pass. H. 4189 rewrites Section 1-23-600(H)(1) of state law so people asking for a contested-case hearing are pointed to the right successor agency, not the old Department of Health and Environmental Control, or DHEC.
The section at issue covers timely filed requests for hearings over decisions made by departments governed by a board or commission with state authority. Once DHEC was split, that language needed to catch up, especially for residents and businesses that challenge permits, licenses or other agency decisions.
When the old name points nowhere
The practical problem with stale code is not abstract. A permit holder, license applicant or lawyer can lose time if a statute sends them to an office that no longer handles the matter. H. 4189 is meant to keep those instructions aligned with the state’s current setup, which now includes the Department of Public Health and the Department of Environmental Services.
That makes the bill less about policy than about routing. It does not create a new program or change who gets regulated. It makes sure the legal map still matches the ground after the agency reorganization.
