Hamtramck special-ed families must use IDEA hearings first

Hamtramck families who say their children were shortchanged in special education did not get a direct route to federal court. The Sixth Circuit said the usual hearing process under the Individuals with Disabilities Education Act, or IDEA, comes first, even when parents want broader court-ordered changes than money alone.

Three parents filed suit in 2023, each alleging that Hamtramck Public Schools failed to make good on a promise of education specially designed to meet their child’s unique needs. The court said those claims still had to go through IDEA’s due-process system before a judge could reach them.

The remedy the court wouldn’t skip

The case was not just about damages. Along with money under other federal laws, the parents asked for an injunction that would identify an expert group to provide corrective measures and a special monitor to oversee implementation. That kind of relief would have reached into how the district operates, not just how it pays out a claim.

The majority rejected a broad systemwide-exception theory for IDEA exhaustion, even though the parents pointed to alleged understaffing and underfunding. The ruling leaves the hearing process in place as the first stop for families who believe a district is failing children across the board.

A narrower opening remains

The decision was not a blanket shutdown. A concurrence said the judgment should be reversed, but suggested that a narrower futility exception may still exist in other cases. That leaves some room for future plaintiffs, though not the broad bypass the Hamtramck families were seeking.

For families, the practical message is blunt. If the complaint is that a district’s special-education system is broken, the court still wants the dispute to start with the administrative hearing Congress built into IDEA.
