In New Jersey, the question is no longer just how much power the state can add. It is whether the grid can stay reliable as electricity demand rises and PJM capacity costs climb. The Clean Firm Energy Reliability Act would direct the Board of Public Utilities to create a program to procure additional clean firm electricity generation in the state, with advanced nuclear reactors explicitly included.
That is a bet on resources that can run continuously and still fit the state’s clean-energy goals. The bill says nuclear already supplies about 40% of in-state electricity and 80% of carbon-free generation, making it the backbone of New Jersey’s current low-carbon supply.
The kind of power the state wants
The proposal narrows the menu on purpose. A clean firm energy resource would have to produce zero or near-zero greenhouse gas emissions, be dispatchable, be fuel secure and be capable of continuous operation. It would also need to carry capacity and reliability value in PJM’s market.
That matters because the state is not simply shopping for another clean label. It is looking for electricity that can support the grid when customers need it most, not only when the weather cooperates or the sun is up.
Advanced nuclear reactors get a central role in that argument. Under the bill’s definition, they are reactors with significant improvements over older designs, including better safety features, lower waste yields, stronger fuel performance, more resilience and greater proliferation resistance. The legislation also points to a recent law that removed outdated permitting barriers to new nuclear facilities.
The rules around the purchase
If enacted, the Board of Public Utilities would have to issue a request for expressions of interest within 180 days. Developers would need to spell out the project’s licensing path, timeline, financing plan, expected output and projected monthly bill impact before the board could decide whether a project qualifies.
Any final agreement would have to lock in milestones, costs, reporting requirements and a funding schedule. It would also require a project labor agreement, prevailing wages, at least 15% of construction labor hours performed by apprentices, wildlife protection efforts, community engagement, public education and U.S.-based materials where feasible.
The stakes are practical: reliability, fuel security and the direction of New Jersey’s future power mix. The bill does not promise cheaper bills on its face, but it does show where lawmakers want the state to look for steadier supply.
