Ohio bill would let more nurses pronounce death

In Ohio, a person’s final moments can still be slowed by a question of paperwork: who is allowed to make the formal call. A proposal in the state would let nurse practitioners and clinical nurse specialists determine and pronounce death, giving families and hospice teams a clearer process at the bedside.

The change matters because the moment is already heavy. When a death is determined and pronounced, the bill says the nurse must notify the deceased person’s next of kin, personal representative or other legal designee within a reasonable time, and no later than 24 hours.

When the moment has to move

For patients at the end of life, that authority can reduce the kind of delay that turns grief into confusion. In hospice and other clinical settings, the difference is not abstract. It is whether the person standing closest to the patient can complete the process cleanly, without waiting for someone else to arrive just to sign off on what has already happened.

The bill’s 24-hour notification deadline is part of that same logic. It gives families a set outer limit for hearing the news, instead of leaving the timing open-ended when the bedside team is already managing care, documentation and the practical aftermath of a death.

The rulebook behind the bedside

The proposal does more than adjust end-of-life authority. It also revises parts of Ohio law tied to the Board of Nursing and the professionals it regulates, including definitions of “nurse” and “physician” for related provisions. That cleanup is meant to make the state’s nursing rules fit together more clearly.

The practical effect is straightforward: fewer questions about who can act, and fewer legal seams in a moment that rarely offers much room for delay.
